Persons with exceptional
ability in the arts, sciences, or business may apply for an exemption from the requirement
of a job offer if the exemption would be in the national interest, in which case
the alien may file the petition along with evidence of the national interest. If
this type of visa petition is granted, the petitioner will be given an immigrant
visa (“green card”).
Exceptional ability in
a particular field means having a degree of expertise significantly above that ordinarily
encountered within the field.
Independent applicants
in this category must have extensive documentation showing sustained that they have
the necessary degree of expertise, and that their admission to the United States
would be in the national interest of the country.
